General Terms of Service of Tipme platform

  1. General terms

    1. TIPME OÜ (reg. No 16259088), as the operator of the TIPME Platform, has established these General Terms of Service for the Users of TIPME platform.
    2. User has to read and accept these General Terms of Service before using the Platform. In case the User does not accept the General Terms of Service, he can not use the Platform.
      Accept of the present General Terms of Service and the Privacy Policy is made when User enters the Platform to tip or/and review the waiter or when User makes application to join TIPME platform.
      By making a payment of tips on TIPME platform User (Guest) automatically agrees with the present General Terms of Service.
      Before sending application for joining the TIPME platform User (Administrator or Waiter) confirms that he has read and accepts the present General Terms of Service by ticking “I accept the General Terms of Service and Privacy Policy” box in the application form.
    3. These Terms of Service shall be governed by and construed in accordance with the laws of Estonia.
    4. Accepting the present General Terms of Service User also confirms that he has read and accepts the Services Agreement of the Stripe payment system, which can be found on https://stripe.com/en-ee/ssa

  2. Definitions

    1. Platform – TIPME platform on www.tipme.ai which provides an opportunity for freewill and gratuitous non-cash transfer of money (tips) from a Guest to a Waiter, registered in the Platform, to his private account, as well as to review a restaurant and/or waiter performance.Platform Operator – TIPME OÜ.
    2. User – any visitor of the Platform. Platform defines three types of Users, which differ in rights and obligations: “Guests”, “Waiters”, “Administrators”.
      Guest – unregistered User of the Platform, who has the right to make freewill and gratuitous non-cash money transfers (tips) on the Platform, as well as to make reviews on Waiter and/or restaurant performance.
      Waiter – registered User of the Platform, who can receive money transfers (tips) from the Guests to his private account.
      Administrator of the restaurant – registered User of the Platform, who can provide access to the Platform for the Waiters and control and monitor money transfers (tips) and reviews on Waiters’ and/or restaurant performance.
    3. Payment system – partner(s) of the Platform, which provide(s) money (tips) transfer service from Guests to Waiters.
    4. Personal data – any personal information of the User, received by the Platform.
    5. Tip(s) – freewill and gratuitous non-cash money transfers from Guests to Waiters.

  3. Using the TIPME Platform

    1. Platform provides an opportunity for:
      • freewill and gratuitous non-cash money transfer (tips) from Guest to Waiter via Payment System
      • making review on Waiters’ and/or restaurant performance
    2. Freewill and gratuitous money transfer can be fulfilled by:
      • payment with the Guest’s bank card via Platform and Payment System
      • payment with the Guest’s bank card via mobile payment system (ApplePay, GooglePay)
    3. Money transfer via Platform and Payment System is made on the website of the Platform. To make money transfer the Guest needs to choose the Waiter and indicate the amount of transfer. After that the Guest will be redirected to a secured page of the Payment System.
    4. If the bank card of the Guest supports 3D secure technology, an additional security check by the bank is needed. The Guest will be redirected to the bank page for bank security check.
    5. The Users bear responsibility for calculation and payment of all fees and taxes that legally apply to the money transfers on the Platform.
    6. Accepting these General Terms of Service and providing information to the Platform, User bears responsibility for reliability of the provided information.
    7. Payment security is provided by the Stripe Payment System. The personal data of the User, necessary for payment, is not available for the Platform operator and is only processed and fully secured by the Stripe Payment System. Nobody, including Platform operator, has access to billing and personal information of the payer.
  4. Rights and responsibilities of the User and the Platform operator
    1. User has the right:
      • to use the functions of the Platform according to his User’s category
      • to provide personal data, necessary for operations on the Platform, to the Platform operator
      • to write to Customer support of the Platform any questions, complaints or suggestions to email: [email protected]
    2. User is obliged:
      • to provide reliable, precise and full information using the Platform. User agrees that Platform operator is not obliged to check the reliability of the provided information
      • to refresh personal data, provided to the Platform, in case of change
      • not to fulfill any actions on behalf of a third person, not to provide personal data of a third person, not to use in any way personal data of a third person. User bears responsibility for any of these actions, including in case they cause any losses to the Platform
      • not to transfer his account for use of a third person, as well as his login and password information; to be responsible for confidentiality of this information
    3. Platform operator has the right:
      • to change/update the General Terms of Use and Privacy Policy
      • to deny access to the Platform for User at any time. Denial can be made by denial of money transfer, denial of registration, account deletion. Platform operator is not obliged to reveal the reason of denial of access
      • to engage partner companies for Platform operations, complying with the present Terms and Privacy Policy
    4. Platform operator is obliged:
      • to provide services to the Users in compliance of the present General Terms of Use
      • to support troubleproof work and functionality of the Platform, excluding cases when it is impossible for reasons beyond the Platform operator’s control
      • to provide security and nondisclosure of personal data provided by the User in compliance with the present Terms. The Platform operator is obliged not to disclose, not to provide, not to spread personal data to any third party without direct consent of the User
    5. Terms of payment
      Commission of the Platform is 8% (eight per cent) of the transferred tip amount. No other payments or commissions apply to the Users of the Platform.
    6. Miscellaneous
      1. The present General Terms of Use are valid from the moment of accept of the General Terms of Use and Privacy Policy according to article I.2. of the present General Terms of Use.
      2. Accept of the present General Terms of Use confirms full consent with the terms of these General Terms of Use.
      3. Platform operator does not bear responsibility for the services provided by the third parties, including the partners of the Platform.
      4. Platform operator reserves the right to make changes to the General Terms of Use at any time, by uploading the revised General Terms of Use onto the TIPME website and notifying the Users thereof through the email address provided by the User during signup. The changes to the General Terms of Use are valid from the moment of their upload to TIPME website. User has the right not to accept the changes to the General Terms of Use, which means denial of the User to use the Platform.
      5. The present General Terms of Use are published on the official website of the Platform: www.tipme.ai
      6. The use of the Platform and all legal relations formed thereunder will be governed by the laws of Estonia. If the respective dispute resulting from these General Terms cannot be settled by negotiations, then the dispute will be finally solved in Harju County Court in Tallinn, Estonia.
